1. Introduction

These terms and conditions apply to your use of the Target Language Academy website (targeteducation.ac.nz) and to your enrolment in our coaching services. By using our website or enrolling with us, you agree to these terms. Please read them carefully.

2. Definitions

• "We", "us", "our", "TLA": Target Language Academy, also trading as Target Education, part of the ProVisas group.
• "You", "the Student": the person using our website or enrolling in our services.
• "Services": the English-language coaching and related support we provide.
• "ProVisas": the part of our group through which a licensed immigration adviser provides immigration advice.

3. Our services

We provide English-language exam coaching for PTE and IELTS, delivered at our Manukau and Papakura centres and, where offered, online. Our service is English-language coaching only. We do not provide immigration advice (see section 11).

4. Enrolment and booking

You can enquire, book an assessment, or enrol through our website, by phone, or in person. Your enrolment is confirmed once we accept it and any required payment or deposit is received. You are responsible for giving us accurate information when you enrol.

5. Fees and payment

Course fees are as quoted to you at the time of enrolment. Online payments are processed securely by our third-party payment provider, Stripe; we do not store your full card details, and Stripe's own terms apply to the payment. Any deposit, instalment, or payment-timing arrangements will be set out when you enrol.

6. Promotions and discounts

From time to time we run promotions, such as a discount for enrolling online. The eligibility, conditions, and period of each promotion are stated with the offer. Unless we say otherwise, promotions cannot be combined with other offers, and we may vary or withdraw a promotion at any time.

Online enrolment discount. Where we offer a discount for enrolling online, such as our website promotion code, the following also applies:

• The discount is available only when you enrol and pay online through this website and enter the valid promotion code at checkout. It is not available for payments made in person at our centres, by phone, or on a walk-in basis.
• The discount applies only to the courses that are marked as eligible with the offer. Any course that is not marked as eligible is charged at its full price.
• Entering the promotion code is your responsibility. Please add the code and check that the discounted amount is shown before you complete your payment. If the code is not entered, the discount will not be applied, and the amount you pay will stand.
• The discount cannot be added after a payment has been completed. If you have already paid for a course, whether in person or online without the code, we are not able to apply the discount afterwards, adjust it retrospectively, or refund the difference.
• Please do not request this discount when paying at our centres or on a walk-in visit, as it applies to online enrolments made through this website only.
• Once you have entered the code and paid the discounted amount, applying the code correctly and the payment you have made are your responsibility, and your enrolment is subject to these terms.

7. Cancellation, rescheduling, and refunds

If you need to cancel or reschedule, please contact us as early as possible and we will do our best to help. Any deposit, cancellation, or rescheduling conditions that apply to your enrolment will be set out at the time you enrol. Nothing in this section limits the rights you have under the Consumer Guarantees Act 1993.

8. Student responsibilities and conduct

To get the most from your coaching, you agree to attend your sessions, prepare as advised, give us accurate information, and treat our staff and other students with respect. We may decline or end a service where conduct is unsafe, unlawful, or seriously disruptive.

9. No guarantee of results

We provide our coaching with reasonable care and skill. However, your examination result depends on your own preparation, ability, and performance, and on the test provider's assessment. We do not and cannot guarantee any particular score, a pass, or any visa or immigration outcome.

English requirements for New Zealand visas are set by Immigration New Zealand as pass or fail thresholds, and visa decisions are made by Immigration New Zealand, not by us. Nothing in this section limits the guarantees you have under the Consumer Guarantees Act 1993.

10. Intellectual property

Our course materials, practice tests, recordings, and other resources are owned by or licensed to us. They are provided for your personal study only. You may not copy, share, resell, publish, or distribute them without our written permission.

11. Third-party services and immigration advice

Our website and services use third-party providers, including Stripe (payments), Cal.com (bookings), our AI voice assistant powered by ElevenLabs, and analytics providers. Each has its own terms and privacy practices.

Immigration advice. Target Language Academy provides English-language coaching only. We do not provide immigration advice. Immigration and visa advice is provided only by a licensed immigration adviser within the ProVisas group, in accordance with the Immigration Advisers Licensing Act 2007. Our coaching staff cannot advise you on visa eligibility, applications, or immigration outcomes.

12. Limitation of liability

To the extent permitted by law, and subject to the Consumer Guarantees Act 1993, our total liability to you in connection with our services is limited to re-supplying the affected coaching or refunding the fees you have paid for it. We are not liable for outcomes that depend on third parties, including test providers and Immigration New Zealand.

13. Privacy

We handle your personal information in line with our Privacy Policy, which explains what we collect, how we use it, who we share it with, and your rights under the Privacy Act 2020.

14. Changes to these terms

We may update these terms from time to time. The version published on our website at the time you enrol applies to that enrolment. The current version, and the date it was last updated, are shown at the top of this page.

15. Governing law and jurisdiction

These terms are governed by the laws of New Zealand, and the New Zealand courts have jurisdiction over any dispute relating to them.
